Remedies for Those Injured by Covid-19 Vaccines
There is a new bill that has been introduced called the Vaccine Injury Modernization Act. If passed, this act will improve the Vaccine Injury Compensation Program (VICP) by addressing current issues within the program. Some of these updates will facilitate the addition of the Covid-19 vaccine to the vaccine list covered by the VICP. For example, whereas now the HHS can only add new vaccines/injuries to the injury table 2 years after CDC recommendation, the Vaccine Injury Modernization Act would expedite this process by allowing the HHS to add vaccines to the injury table within 6 months of a CDC recommendation. Further, with the passing of this bill, the VICP would have to include vaccines/injuries recommended by the CDC for routine administration in adults as opposed to just children as it does now. Both of these updates to the VICP would allow the Covid-19 vaccines a greater chance to be accepted into this program. If the Covid vaccines were to be added to the VICP, this would benefit persons injured by the Covid-19 Vaccine because the VICP is a more legitimate fund and can provide more money for the requester.
However, as of now, the Covid 19 vaccine is covered by the Countermeasures Injury Compensation Program (CICP). Through the CICP you may be compensated for:
- Medical expenses from the injury
- Lost employment income
- Benefits to the estate
- Survivor death benefits
* Note that the CICP benefits do not include compensation for pain & suffering, future medical care, or attorneys fee as the VICP benefits do.
